AG from conservative state opposes Biden’s immigration lawsuit

Oklahoma’s Attorney General is standing firm in the face of a lawsuit from the Biden administration regarding its anti-illegal immigration law, asserting the state’s confidence in the bill’s legality and willingness to defend it against federal intervention.

The law, signed by Governor Stitt and set to take effect on July 1, is reminiscent of similar legislation passed in Iowa and Texas, which have both faced DOJ lawsuits. The DOJ argues that these laws infringe on federal jurisdiction over immigration enforcement. The Texas law is presently on hold pending ongoing legal proceedings.

Principal Deputy Assistant Attorney General Brian Boynton expressed the DOJ’s stance, emphasizing that Congress has established a comprehensive framework for regulating noncitizens’ entry and reentry into the U.S., including specific penalties for unlawful actions. Boynton claimed that Oklahoma’s HB 4156 attempts to create a separate state immigration system by penalizing violations of existing federal laws, thereby encroaching on federal authority.

The U.S. intends to file a lawsuit unless Oklahoma agrees to abstain from enforcing the law, with a deadline for a response set for May 20. In response, Oklahoma Attorney General Gentner Drummond dismissed the DOJ’s concerns as a distraction, asserting the necessity of the bill to combat illegal activities facilitated by Chinese nationals and Mexican cartels within the state.

Drummond emphasized the bill’s focus on prosecuting and detaining criminals, rather than deporting individuals, clarifying that Oklahoma does not aim to implement deportation measures typically performed by the federal government. Despite opposition from some factions in the state, Drummond highlighted the bill’s support among Republicans in the state government, underscoring his independent determination of its legality and benefits to Oklahoma.

He confidently affirmed his position, proclaiming his role as the one to call the shots, emphasizing the necessity of combating organized crime in the state through legislative measures. Drummond’s unwavering support for the bill stems from his belief in its capacity to address critical issues plaguing Oklahoma.

Despite potential challenges ahead, Oklahoma remains resolute in its commitment to uphold its anti-illegal immigration law, prepared to engage in legal battles to defend its sovereignty and protect its residents from criminal activities associated with illegal immigration.
