Appeals Court Denies Trump’s Request to Lift Gag Order

Former President Donald Trump faced a setback as the Appellate Division of the New York Supreme Court rejected his appeal to lift a gag order that has restricted him from speaking out about various aspects of an ongoing case.

The court upheld the decision made by Justice Merchan, stating, “We find that Justice Merchan properly weighed petitioner’s First Amendment Rights against the court’s historical commitment to ensuring the fair administration of justice in criminal cases, and the right of persons related to the proceedings to be free from threats, intimidation, harassment, and harm.”

Despite the rejection, Trump’s legal team has the option to appeal the gag order to the New York Court of Appeals, keeping the legal battle ongoing.

Trump, along with his supporters, has vocally criticized the gag order, claiming it infringes on his rights and hinders his ability to defend himself against critics and adversaries.

Judge Juan Merchan imposed the gag order on Trump before the commencement of his criminal trial in New York, prohibiting him from making public statements about witnesses, counsel, court staff, or the prosecution team and their families.

During the trial, Merchan found Trump in violation of the order on multiple occasions, resulting in a $10,000 fine for the former president. The violations stemmed from messages posted by Trump on social media platforms and his campaign website.
