The House Judiciary Committee recently took a significant step by advancing a resolution to hold Attorney General Merrick Garland in contempt of Congress. This decision stems from the Justice Department’s failure to produce the subpoenaed audio recording of President Biden’s interview with Special Counsel Robert Hur.

This development follows the White House’s action to assert executive privilege over the audio and video recordings related to Hur’s interviews with President Biden as part of the classified records investigation.
During a meeting with federal, state, and local law enforcement leaders in New York City on November 27, 2023, Attorney General Merrick Garland emphasized the need to protect law enforcement files. White House press secretary Karine Jean-Pierre reiterated the attorney general’s stance, affirming that President Biden’s decision to assert executive privilege was made in accordance with this principle.
The Democratic National Committee found itself in a position where they had to pay lawyers representing President Biden amidst an investigation by Special Counsel Robert Hur. Despite months of investigation, Hur’s report, released in February, did not recommend criminal charges against President Biden for mishandling and retaining classified documents. Moreover, Hur indicated that he would not pursue charges against Biden, even if he were not holding the presidential office.
