Senate Judiciary Committee Chairman Dick Durbin and Chairman of the Judiciary Subcommittee on Federal Courts Sheldon Whitehouse penned a letter to Roberts, expressing concerns about Alito’s actions. They accused Alito of engaging in political activity by displaying the upside-down American flag and the “Appeal to Heaven” flag at his homes, creating doubt about his impartiality in cases related to the 2020 presidential election and the Capitol attack. The lawmakers requested a meeting with Chief Justice Roberts promptly to address the matter.

Recent reports revealed that Alito’s home flew an upside-down American flag shortly after the Capitol riot, and his vacation home displayed an “Appeal to Heaven” flag, leading to further scrutiny of his actions. The Democratic senators emphasized the need for Alito’s recusal from election-related cases, citing concerns about his impartiality on the 6-3 conservative majority court.

In response to the controversy, some Republicans defended Alito, pointing out the historical significance of the “Appeal to Heaven” flag. The motto, tied to a quote from philosopher John Locke, symbolizes resistance against unjust authority and tyranny. Senators like Tom Cotton and Mike Lee expressed support for Alito and his wife’s display of the historic flag. Speaker Mike Johnson also showed solidarity by flying the flag outside his personal House office.
