Republicans are suing Merrick Garland for a recording of Joe Biden’s interview with Robert Hur.

House Republicans are taking U.S. Attorney General Merrick Garland to court over his decision to not release the audio of President Joe Biden’s interview with former special counsel Robert Hur. The interview, in which Hur described Biden as “an elderly man with a poor memory,” has sparked concerns about the President’s mental acuity in recent months.

Following Biden’s evident struggles during a recent debate, Republicans are eager to obtain the Hur audio to shed further light on the President’s age-related challenges. House Speaker Mike Johnson expressed his belief that the audio would reveal Biden’s performance to be in line with his recent public appearances, adding that the intention is not to embarrass the President but to uncover the truth.

While the Justice Department has provided Republicans with a transcript of the interview, the audio has been withheld on the grounds that its public release could hinder future investigations by undermining the confidentiality of conversations with law enforcement. In the transcript, Biden appears to have difficulty recalling whether his son Beau was still alive when he was contemplating his presidential run in 2017 and 2018, prompting aides to clarify that Beau had passed away in 2015.

Republican calls for the audio date back to their impeachment inquiry against Biden, which has centered on unsubstantiated claims regarding business dealings involving his son, Hunter Biden. Questions have also been raised about Hur’s decision not to prosecute Biden for mishandling classified information, particularly given former President Donald Trump’s indictment for similar offenses.

In response to the administration’s refusal to release the audio recordings, the House Judiciary Committee, led by Chairman Jim Jordan, has sought court intervention to enforce their subpoena for the digital files.
