Sen. Durbin wants Justice Alito to step aside from Trump cases after flying flag upside-down.

Senate Judiciary Committee Chairman Dick Durbin, D-Ill., has called on Supreme Court Justice Samuel Alito to recuse himself from any cases related to the 2020 election. This call to action came after an upside-down flag was flown at Alito’s home a week after the Capitol riot on Jan. 6, 2021.

According to Durbin, flying an upside-down American flag, a symbol associated with the ‘Stop the Steal’ movement, creates a clear appearance of bias. He stated, “Justice Alito should recuse himself immediately from cases related to the 2020 election and the January 6th insurrection, including the question of the former President’s immunity in U.S. v. Donald Trump, which the Supreme Court is currently considering.”

The decision of the Supreme Court in the federal election interference case involving former President Trump heavily depends on what the Court determines about his claim of immunity. Durbin emphasized the urgent need for the Court to address the ethical crisis it is facing and regain public trust.

Durbin suggested that Congress should establish a code of conduct for the Supreme Court and promote the passage of the Supreme Court Ethics, Recusal, and Transparency Act. He stressed that Supreme Court justices should be held to the highest ethical standards.

In the aftermath of the Capitol riot in 2021, during which Trump supporters sought to prevent the certification of the 2020 election results, the Alito household was observed displaying an upside-down American flag. This act, symbolizing a nation in turmoil, gained significance as a form of protest against the election outcome.

Following a disagreement with a neighbor regarding a profane sign hung on their property, Justice Alito’s wife, Martha-Ann, faced further confrontation when the neighbor placed blame on her for the events of Jan. 6. The situation escalated when the neighbor verbally assaulted Martha-Ann during a subsequent encounter.

Justice Alito clarified that the decision to hang the upside-down flag was in response to the ongoing feud with their neighbors and was intended to be a temporary display. He refrained from intervening in his wife’s choice, describing their neighbors as highly politically motivated.

The demand for Justice Alito’s recusal from election-related cases highlights the contentious environment surrounding the Supreme Court’s involvement in matters of national significance. As the ethical standards of the Court come under scrutiny, the need for transparency and accountability becomes increasingly pressing.
