Special Counsel opposes delaying Hunter Biden trial

Federal prosecutors are making a strong case against Hunter Biden’s request to delay his upcoming California tax trial and are urging a judge to deny the delay. This news comes amidst a busy summer for the president’s son, who is also facing a separate criminal trial in Delaware. Special Counsel David Weiss highlighted that Biden’s attorney had previously agreed to the trial dates last year and therefore a continuance should not be granted.

The motion filed by Weiss stated, “No defendant would be afforded a continuance because he wrongly chose to lodge a jurisdictionless appeal, and this defendant should be treated no differently.” The defense counsel’s reasons for requesting a delay of 77 days were also deemed insufficient by Weiss, who believes that the motion for continuance should be denied.

It was mentioned that Biden’s lead counsel agreed in April of 2023 to proceed with the trial in Delaware, where Biden is facing federal gun charges, even though the tax trial in California was set to begin on June 20. The Delaware trial is expected to start on June 3.

Regarding the reasons for the delay requested by Biden’s lead counsel, the court document stated, “In his latest effort to delay trial (an application for a continuance), defendant’s lead counsel’s primary reason is the weeklong June 3, 2024, trial in Delaware at which he is one of the lawyers representing the defendant with respect to firearms charges.” This raised questions given that the lead counsel previously confirmed his availability for the Delaware trial on June 3, knowing that the tax trial in California was scheduled for June 20.

Recently, a federal judge declined a request to postpone the gun case to September, stating her belief that all necessary tasks can be completed before the trial commences on June 3. Furthermore, a three-judge panel of a federal appeals court also ruled in favor of allowing the tax case against Biden to move forward, thereby denying any delays.

In the Delaware case, Biden is facing accusations of providing false information about his drug use in October 2018 while attempting to purchase a gun that he kept for 11 days. He has pleaded not guilty to these charges. On the other hand, in California, he is charged with multiple felonies and misdemeanors related to over $1.4 million in unpaid taxes from the years 2016 to 2019.
