West Virginia Transgender Athlete Wins Against Girls in Track Events 700+ Times, Legal Filing Claims
Recent court proceedings have revealed alarming statistics regarding the impact of a transgender track-and-field athlete at a West Virginia middle school on girls’ sports. According to a new court filing in a lawsuit against the Biden administration’s changes to Title IX, this transgender athlete displaced girls over 700 times in just three seasons.
Alliance Defending Freedom (ADF), a nonprofit civil rights firm, filed a motion on Thursday urging the 6th Circuit Court of Appeals to halt the implementation of the Biden administration’s new Title IX rules and allow state laws banning transgender athletes from competing on girls’ sports teams to remain in effect.
Secretary of Education Miguel Cardona issued new rules last month that expanded sex discrimination to include gender identity and sexual orientation. While the administration maintains that this change will not affect sports, ADF argues otherwise. The senior counsel for ADF, Rachel Rouleau, called the administration’s redefinition of sex “radical” and warned that it could undermine the progress women and girls have made under Title IX over the past 50 years.
ADF highlighted a specific case in West Virginia where a transgender student was permitted to compete on the girls’ team despite legal challenges. This student reportedly outperformed girls more than 700 times in cross-country and track-and-field events. Rouleau emphasized the impact of such decisions on the safety and privacy of female athletes.
As part of a larger lawsuit involving multiple states, ADF’s motion seeks to challenge the Department of Education’s recent changes to Title IX.
